When the Teachers Service Commission deducted housing levy from teachers in the month of January, TSC Chief Executive Officer Nancy Macharia defended the Commission by arguing that by the time the court rendered the ruling, commission had already processed the teachers payroll
.
Despite the court ruling that the housing levy is illegal, Teachers have claimed that housing levy has once again been deducted from their month of February salary, According to KUPPET, several payslips for the month of February confirmed the deductions.
Therefore, Attorney General Justin Muturi told Kenya Revenue Authority to stop collecting housing levy from salaried Kenyans, saying it lacks legal basis. In letter to KRA Commissioner General Humphrey Wattanga, AG said, “there is no legal basis on which the housing levy can be implemented, as of 26th January 2024, there is no legal provision that enables collection and administration of the housing levy…”
Therefore, KUPPET says when general deductions were done, the union wrote to the commission demanding that teachers may be refunded.
After passing in the National Assembly, the affordable housing bill is currently in the senate and according to the Kenya Kwanza Government and Parliamentary group, the bill is supposed to be ascended to by the President by mid March so that by 1st April, deductions for housing levy will officially start and before Parliament regularised the procedure, KUPPET insists teachers must be refunded.
