The government has pledged to release all documents related to the suspended Kenya\u2013United States health partnership, following a High Court order halting the implementation of the multi-billion-shilling agreement.<\/strong><\/p>\n\n\n\n

On Wednesday, December 10, Justice Lawrence Mugambi issued conservatory orders temporarily suspending the health cooperation framework signed on December 4, 2025, pending a full hearing. The court directed that no provisions of the agreement be implemented until the matter is conclusively determined.<\/p>\n\n\n\n

In response, Health Cabinet Secretary Aden Duale on Friday, December 12, confirmed the government\u2019s intention to comply with the court\u2019s directive, while also preparing to challenge the ruling.\u201cWe fully recognise and respect the crucial role of the courts in interpreting the law,\u201d Duale said. \u201cWe note that the current conservatory orders are specific to the sharing of data and do not suspend the broader partnership.<\/p>\n\n\n\n

\u201dThe CS clarified that the suspension only affects sections of the agreement related to data sharing, countering claims that the entire deal had been nullified. He expressed confidence that once the court reviews the full documentation, which was not available at the time of the interim ruling it will better understand the intent and safeguards embedded in the agreement.<\/p>\n\n\n\n

Duale emphasized that the health framework is a cooperative policy arrangement, not an international treaty, and was developed in compliance with Kenya\u2019s legal standards, including the Data Protection Act of 2019 and the Digital Health Act.\u201cWe emphasise that this framework was drafted with strict adherence to due process, ensuring that Kenya\u2019s sovereignty, data ownership, and intellectual property are fully protected,\u201d he stated.<\/p>\n\n\n\n
