The Kakamega High Court on Friday, May 15, dismissed a petition challenging the election of Malava Member of Parliament David Ndakwa, confirming his victory in the November 27, 2025, by-election.Justice Stephen Mbugi ruled that the petition filed by Ndakwa’s closest rival, Seth Panyako, lacked merit.
Panyako had asked the court to nullify the results, alleging widespread irregularities that he said skewed the outcome in Ndakwa’s favor.In his judgment, Justice Mbugi affirmed that Ndakwa was validly elected as the MP for Malava Constituency.

Following the ruling, Ndakwa and his supporters celebrated outside the courtroom before marching through the streets singing victory songs. “The will of the people of Malava has prevailed,” Ndakwa said in a brief statement after the decision.
The case marks the end of the legal challenge to the Malava by-election.
